A bit of quiz fun to test knowledge

Our driver called 'DRIVE' has just had a nice 9 day holiday - lucky DRIVE !!

WEEK 1
Mon - start work 6am (driving time = 6 hours)
Tue -work (driving time = 7 hours)
Wed -work (driving time = 9 hours)
Thu -work (driving time = 7 hours)
Fri -work (driving time = 8 hours)
Sat -work (driving time = 7 hours)
REDUCED weekly rest - 36 hours off

WEEK 2
Mon - start work 6am (driving time = 8 hours)
Tue -work (driving time = 7 hours)
Wed -work (driving time = 8 hours)
Thu -work (driving time = 8 hours)
Fri -work (driving time = 7 hours)
Sat -work (driving time = 8 hours)
REDUCED weekly rest - 33 hours off

WEEK 3
Mon - start work 6am (driving time = 8 hours)
Reduced daily rest
Tue -work (driving time = 7 hours)
Full daily rest
Wed -work (driving time = 8 hours)
Reduced daily rest
Thu -work (driving time = 7 hours)
Reduced daily rest
Fri - Start shift at 6am
Other work for 30 mins
Drive for 2 hours
Other work for 30 mins
Drive for 2 hours
Other work for 1 hour
Drive for 2 hours
Other work for 1 hour
Drive for 3 hours
End shift
Sat - work (driving time = 6 hours)
FULL weekly rest
DRIVE is helping his son to move house this weekend by hiring an 18 tonner with a tail lift - no rest for the 'wicked' - LOL

QUESTIONS: -
1 - What break(s) are needed for Fri in WEEK 3 so that DRIVE can start as early as possible on Sat ?
2 - What is the earliest time DRIVE can start on Sat ?
3 - Are the driving hours over the 3 WEEKS ok ?
4 - Are the weekly rests ok ?
5 - At the end of week 3 is any weekly rest payback still owing ?
6 - Has DRIVE done anything else illegal ?

1. Well if you look at your examples Rog, he can not work on the Saturday in week 3 because he worked 6 shifts the previous week. He should be making Friday his last shift and then taking a minimum of 45 plus the 9 hours owed from week 1 so he cant officially start until midnight on Sunday.
2. He cant. See above.
3. The weekly and fortnightly driving hours totals are ok but there appears to be a breach of the 4.5 hour driving rule without a break on Fri in week 3.
4. no, there are 2 consecutive reductions in weeks 1 and 2.
5. 9 hours from week 1
6. yes, No break on Friday, 2 consecutive reductions in weekly rest but other than that all is ok providing he wasnt being paid for the removal.

Boss - the weekly rests are legal but can you see why ?
Fri of week 3 needs the break(s) putting in - see Q 1
Perhaps a recount of the driving hours......

Nope, still dont agree Rog. Driver is having 2 consecutive reductions in weekly rest. Any 2 weekly period should contasin at least 1 45 hour rest so if you look at those 2 weeks there is not a 45 hour rest.

Question 1 could do with rewording.

Based upon your "test" suggestion in the dcpc thread then the questions would need to be a little bit clearer Rog or we would all fail.
Also, just because somebody knows the rules very well does not make them a decent driver.

How is Q1 not clear ??
Minimum amount of break(s) need to be inserted so the driver can start as early as possible the next day (Sat)

I'll post the answers on Sunday so others can have a crack at it over the weekend

Ahhhh, your second version of question 1 is a little clearer Rog although it is still not worded correctly.

Try:

How many hours "rest" should the driver take on Friday to give him the earliest possible start time on Saturday.....answer = 9 hours off so he can start at 3am.

and:

In the scenario given on Friday, please insert the breaks to make the days hours legal. Answer....take a minimum 45 minute break after the first other work for 1 hour in the scenario. This would then change the answer above to 03.45 start time on Saturday.

Fri has no break(s) listed and that is one of the questions - where should the breaks go so only the minimum amount or break(s) are used

You sure about only 9 hours ??

The truck he hired for the house move is over 7.5 tonnes so comes under EU regs

Further information regarding the Fri of WEEK 3 break(s) question: -

THE BREAKS OF 15 + 30 = 45 COVERS ALL THE TACHO REQUIREMENTS AND ALL THE REUIREMENTS FOR THE RT(WTD)R

The problem with the 6 hour rule has been when mixing up two different parts of the regs

Not the exact way it's written in the regs .....

No driver may WORK (driving + other work) more than 6 hours without taking a break
Each break must be at least 15 mins

That bit above seems simple enough but then we go onto something else and this is where many mix this bit below with the above

If the total WORK in a shift is between 6 & 9 hours then a total of 30 mins of breaks must be taken which could be 1 X 30 or 2 X 15
OR - another important point as it is EITHER one or the other and not both
If the total WORK in a shift is over 9 hours then a total of 45 mins of breaks must be taken which could be 1 X 45 or 3 X 15 or 1 X 30 + 1 X 15 or 1 X 15 + 1 X 30
Two of those look familiar..... I'm sure I've seen them in the tacho regs.....

Breaks count for both the tacho and RT(WTD)R but the tacho regs regarding breaks take priority

hope that helps even if I have said it my way.....

Yes mate
Only vehicles of 7.5 and under are exempt

The Horsey brigade are up in arms about this as many of them have private horseboxes over 7.5
